of
NYELETI GAME FARM (Pty) Ltd t/a KLASERIE CAMPS, trading as NZUMBA LODGE Registration number: 1992/001852/07 (hereinafter “we”, “us” or “our”)
This POPI Policy applies to you when you visit the Nzumba Lodge website or use our products or services.
1. Introduction
This POPI Policy is adopted in terms of the Protection of Personal Information Act No. 4 of 2013 (the “POPI Act”) and the Constitution of the Republic of South Africa, 1996, which provides that everyone has a right to privacy. That right includes protection against the unlawful collection, retention, dissemination and use of personal information.
The purpose of the POPI Act is, among other things, to regulate — in harmony with international standards — the processing of personal information by public and private bodies in a manner that gives effect to the right to privacy, subject to justifiable limitations aimed at protecting other rights and important interests. We respect your privacy. This POPI Policy sets out the manner in which we collect and process personal information, including its dissemination, in terms of the POPI Act.
2. Personal information
Personal information means information that — either on its own or in combination with other personal information held by us — enables you to be identified as an individual or recognised, directly or indirectly. This may include your name, date of birth, sex, postal address, email address, computer IP address, phone number, credit card number (where you pay directly), login information and technical information from the devices you use to receive our services, together with personal information obtained from or about you, directly or indirectly.
3. Manner of collection and processing
We may collect your personal information in the following ways:
3.1 Automatically through our website. When you visit our website, we automatically collect internet-usage information (including your IP address, browser details and usage data) through your browser. We may use this to display our website correctly, to track your activity on it, or for other necessary purposes.
3.2 On submission. We may ask you to provide certain identifying information (such as your first name, surname, email address and phone number) when you make an enquiry, request a booking, or otherwise submit information through our website for the first time.
3.3 Voluntarily. We may ask you to provide certain optional information on a voluntary basis so that we can render the services you instruct us to attend to — for example, dietary requirements, special requests, or details needed to plan your stay.
3.4 Consent to collection. We will obtain your consent to collect your personal information in accordance with applicable law when you provide it to us.
4. Processing — what does this entail?
Processing means the creation, generation, communication, storage and destruction of personal information. By providing your personal information to us, you acknowledge that it has been collected directly from you and you consent to its processing by us.
4.1 We will only collect personal information for a purpose consistent with the purpose for which it is required. The specific purpose will be apparent from the context in which it is requested.
4.2 We will only process personal information in a manner that is adequate, relevant and not excessive in the context of the purpose for which it is processed.
4.3 Personal information will only be processed for a purpose compatible with that for which it was collected, unless you have agreed to an alternative purpose in writing, or we are permitted to do so in terms of national legislation dealing primarily with the protection of personal information.
4.4 We will not disclose any personal information relating to you to a third party unless your prior written agreement and/or consent is obtained, or we are required to do so by law.
4.5 We will only keep your personal information for as long as is necessary to fulfil our obligations to you, unless you have given us permission to keep it longer or we are otherwise legally allowed or required to do so.
5. Your rights
You have the following rights in respect of the personal information we hold about you:
5.1 Revoke consent for direct marketing. You have the right to object to the processing of your data for direct marketing. We will action your objection free of charge and through accessible channels.
5.2 You have the right to access the personal information we hold about you.

5.5 You have the right to have your personal information corrected or deleted (subject to laws that may impose mandatory retention periods).
5.6 You have the right to object to our processing of your personal information; however, we may not be able to render certain services without collecting some of your personal information.
5.7 You have the right to ask us to stop processing your personal information.
